Travis was the first person prosecuted by the Department of Justice's Task Force for election official safety. He accepted a plea agreement to one charge of Threatening Use of a Telecommunication Device. Threats were made through an Instagram account that was not his, but his device was connected to the account. He was sentenced to 18 months in prison. Travis is in need of post-conviction legal services.

Travis had no prior criminal history, no prior threatening or violent behavior, was a contributing member of society, charitable, and kind.
He did not receive a search warrant for "evidence" taken from his phone.
He was never shown forensic analysis of the information on his phone and only claims were made as to what was recovered from his device.
There were 4 other devices connected to this crime and we have reason to believe they have not identified those devices. No other prosecutions have been made.
Travis was leveraged by short deadlines and thus decided to take a plea agreement. While the target letter was signed 5 weeks before the response date, the letter was served to him just three business days before the response leaving him only three business days to retain legal counsel.
Travis had less than 24 hours once he received the plea agreement to decide whether he would accept it. He would face 5 years in prison with only a 1% chance of acquittal had he chose to go to trial.
The threats made may not legally be a violation of the First Amendment as they were not made with language of ownership (i.e. "I" am going to....).
The plea agreement required Travis to sign away many rights, a few noteworthy rights he had to sign away: never deny guilt, never be able to obtain the evidence used against him (not even by FOIA request), and no appeal.
Even though this was not a financial crime his bank, retirement, investment, and credit card accounts have all been closed.
The prosecution was made aware of exculpatory evidence (evidence in favor of the defendant) including screenshots on his phone of his phone having been hacked or compromised. All exculpatory evidence was ignored.
Travis's Instagram locations showed him physically in Des Moines, IA when we were in Nebraska.
His Facebook account had been reactivated 2-3 years after he had cancelled it. He had not reactivated the account himself.
Messages were being sent from an iCloud account he was not operating but appeared to be his.
Travis's case was covered by all major national media outlets twice. His employer had planned to retain him until the first round of media coverage occurred. He has not been able to find employment since.
According to the Statement of Reasons, a form the judge must fill out after sentencing, Travis should have been eligible for 8 of 16 factors making him eligible for a downward departure (lighter sentence). The judge granted him only 2 of the 8 factors.
On record during sentencing, the judge stated Travis's mitigating factors were "non-sense".
Travis qualified for diversion but it wasn't considered.
The Presentence Report recommended three years probation.
