BACKSTORY:

November of 2023 my 3 year old daughters mom lost her job and got evicted from her apartment. I let her move in with me because i didn't want them to be homeless. She started being abusive to me and my daughter, so i contacted the domestic violence hotline, and they cautioned me from using legal means to evict her because if she found out, that the abuse could escalate.

I started secretly recording her being abusive because i knew nobody would believe me unless i had evidence. She soon figured out i was recording her and she got angry. She cornered me in the room and attacked me to try to get the phone from me to destroy my evidence. I defended myself by restraining her then let her go and she left the room. She successfully broke the phone that had video evidence on it. I called the police for help because she had assaulted me and I told them what had happened. Instead of removing her from my place they arrested me and took me to jail since the phone was broken and i couldnt show them the videos of her attacking me.

I spent about a month in jail and finally got bailed out. They put a gps monitor on my leg which is costing $100 and 9 dollars a day after that. By that time my daughters mom got a protection order against me keeping me away from my apartment, even though she isnt on the lease. so ive been homeless sleeping in my van ever since. I was homeschooling my oldest daughter and after this incident her mother got temporary custody of her. I then lost my job after a random background check which showed this case against me.

On top of losing my apartment, my job, and my kids, i totalled my car when someone pulled out in front of me and hit me head on. I broke my ribs and my sternum in the accident and have been in severe pain every day.

I asked my public defender to file motions for me to dispute the protection order but she said that i couldnt fight it at all. She told me "not in cases like this" which i dont think is true at all. I also had her file a motion to get the phone fixed, so i could get the videos of the attack to show the court that i was assaulted. She told me that the prosecutor was getting the phone fixed and we would review the videos together. I got to the meeting and the phone had not been fixed, keeping me in the same position i was in since January.

Meanwhile my daughters mom had been served with a notice to vacate my apartment since she wasnt on the lease. She has finally moved out after running up the utilities and rent up to about $4000. I called the police to see if she was still there and they told me the prosecutor had talked to her and she had in fact moved out and they have her new address. I also contacted probation which they have the new address as well and changed the restricted area for my gps monitor to the new address.

I asked my attorney to file a motion to change the protection order so i could go back to my apartment. She refused to file a motion and told me that she emailed the prosecutor to see if he would let me go back. I called the court and probation and they both told me that it wasn't up to the prosecutor, and that i would have to file a motion to change the protection order. My attorney has failed to file a motion or even contact me back about this.

I need to fire my public defender because she is biased against me and not representing me adequately. I need retain a real lawyer, but they are not cheap. I also need to come up with $4000 for rent and utilities to be able to keep my apartment.
