My name is Jimi, and I have been diving deep into learning Rules of Procedure, how to read and interpret law, and to write lawsuits over the last two years.

As of today, I have file an Application with the Supreme Court of Newfoundland and Labrador to bring a lawsuit over my child being masked by a school official even when there was clear notice given to the school he did not wear them.

The school district has refused to provide us details on what exactly happened, and even failed to create a written investigation report on matter.

I have not been able to find lawyers 1) who practice in the field, 2) would accept the case, or 3) simply would returned contact. We have decided to self-represent our child, but have been halted by the Court.

An application to get an order to serve the school district was present at two hearings with the court saying that even though it is agreed we are the guardian and represent our child - Rule 8.01 (3) of procedure says a guardian MUST act through a lawyer.

We are raising a Constitutional Question challenging Rule 8 because it is 1) restricting access to court for relief unless we can obtain the service of a lawyer, and 2) the Provincial Legislature overstepped its delegated authority infringing on parental rights.

At a time when parental rights are being targeted and attach on multiple levels our Constitutional Question is supremely important. We need all the resources and assistance we can to access essential case law resources used by lawyers to interpret our constitution, legislation, etc.

We are fortunate to have a free resourse, Canlii, that makes an excellent attempt to provide Canadians access to case law. The service is limited in function, searching scope, and depth of resources available. Too many case law precedents are NOT available through canlii.

Legislation is freely accessible - the case law applied or considered by the court to interpret the application of legislation is behind a paywall (Westlaw being one).

We have a system in Canada that is in place to protect our rights, and to limit the actions OUR government can take regarding those rights. The issue is, we aren’t granted easy access to that system. Cases that have set precedent are hard to find, or they seem hidden.

We have committed ourselves to learning how to use this system to help our families, to help our businesses, to help our neighbours, and to help others who need it.

To quote Frederic Bastiat;

What, then, is law? As I have said elsewhere, it is the collective organization of the individual right to lawful defense."
