God intended for children to breathe freely and all children have a constitutional guarantee for equal access to public education.
Katy ISD parents have been fighting for our children to breathe freely all year. What was a temporary measure intended to only last a few weeks, has turned into children as young as 5 wearing a mask up to 9 hours per day, inside, outside, while sitting at their desks, while running in PE. This is harmful for children. We could no longer stand by and allow this harm to come to our kids.
Many parents had to pull their children out of school and face the expense of private school or have their child endure the isolation of virtual school. One mother had to leave her job to stay home with her son, just so he can breathe.
Forcing children into virtual school is a clear violation of each child's constitutionally guaranteed access to free and equal education.
We found a constitutional attorney who was willing to file a lawsuit demanding an immediate injunction for mask requirements to be optional and seek a permanent injunction so the district may never do something like this again. This is not just one case, it is a case of first impression which will pave the way for other districts and government entities when it comes to equal access and mandating health choices for our children.
Katy ISD has over 85,000 students and over 5,600 teachers. If we can be successful in Katy, this should have a domino effect in other districts. Even if you're not in Katy, please consider donating to our legal fund.
